Collective Motion Health, its agents and associated entities are committed to protecting the privacy of your personal information. This Privacy Policy explains how Collective Motion Health manages the personal information that it collects, uses and discloses and how to contact us if you have any questions regarding the management of your personal information.

This Privacy Policy does not extend to any personal information collected or held by Collective Motion Health in relation to its employees and officers.

At Collective Motion Health, we take our privacy obligations seriously and are committed to providing you with the best possible customer service experience. For these reasons, Collective Motion Health complies with;

  • Privacy Act 1988 (Cth) (Privacy Act)

  • Australian Privacy Principles (APP) (subject to the other provisions of the Privacy Act)

  • Spam Act 2003 (Cth) (Spam Act); and

  • Do Not Call Register Act 2006 (Cth) (Do Not Call Register Act)

What is Personal Information?

Personal information is any information or an opinion, in any form and whether true or not, about an identified individual, or an individual who is reasonably identifiable from the information or opinion ascertained. Examples include an individual’s name, address, contact number and email address. Special provisions apply to the collection of personal information which is defined as sensitive information. Sensitive information includes the collection of Health Information for use by a Health Service.

What is Health Information?

Health information is any personal information about your health or disability. It includes information or opinion about your illness, injury or disability.

Some examples of health information include:

  • notes of your symptoms or diagnosis

  • information about a health service you’ve had or will receive

  • specialist reports and test results

  • prescriptions and other pharmaceutical purchases

  • medical records

  • your genetic information

  • your wishes about future health services

  • your wishes about potential organ donation

  • appointment and billing details

  • any other personal information about you when a health service provider collects it

What is a Health Service?

  • A Health Service is defined as an activity performed in relation to an individual that is intended or claimed (expressly or otherwise) by the individual or the person performing it.

  • To assess, record, maintain or improve the individual’s health,

  • To diagnose the individual’s illness or disability,

  • To treat the individual’s illness or suspected illness or disability

  • The Privacy Act applies to all organisations that provide a health service, including Allied Health professionals. Collective Motion Health will only handle the minimum amount of health information reasonably necessary to provide the required health service.

Collection of Personal Information

In order to provide a health service, Collective Motion Health may need to collect personal information about you. To the extent required by the Privacy Act:

  • Collective Motion Health will not collect personal information about you unless that information is necessary for one or more of our functions or activities, and

  • Collective Motion Health will collect personal information only by lawful and fair means and not in an unreasonably intrusive manner.

When Collective Motion Health collects Personal Information and Health Information directly from you, we will take reasonable steps at or before the time of collection to ensure that you are aware of the purposes of collection, any other organisations (or types of organisations) to which we would usually disclose information of that kind, detail on how you access the information and how to contact us.

Why Collective Motion Health collects Personal and Health Information 

Collective Motion Health collects personal and/or health information for a range of purposes including:

  • To provide high quality Health Services

  • Account administration

  • To communicate with you regarding your treatment and any issues that may affect it

  • Provide information on services and benefits available to Clients

  • To notify Clients of upcoming promotions, events and services, and

  • To use for research purposes, case conferences, in study groups and at seminars (please note in these instances, all personal information will be used in a de-identified form)

From time to time, Collective Motion Health will contact its Clients and non-Clients whose personal information has been collected for a range of reasons including:

  • Appointment Reminders

  • Appointment Follow Ups

  • Marketing and promotional material about new products, services or special offers

  • Periodic Newsletters

  • Practice Updates, and

  • Market research or surveys to improve our products and services

Use and Disclosure of Personal and Health Information by Collective Motion Health

Collective Motion Health’s primary purpose for collecting your personal information is to provide high quality health care. If Collective Motion Health uses or discloses your personal and/or health information for a purpose (secondary purpose) other than the primary purpose, to the extent required by the Privacy Act, we will ensure that:

  • You have consented to such use, or

  • The secondary purpose is related to the primary purpose (and directly related in the case of sensitive information) and you would reasonably expect that Collective Motion Health would use or disclose your information in that way.

Where required, Personal Information or Health Information will be disclosed as required or authorised by or under law or as otherwise permitted by the Privacy Act.

You can let us know at any time if you do not wish to be contacted for any of these purposes. If you originally provide consent, your consent will remain current until you advise us otherwise. Collective Motion Health might contact you in a number of ways including:

  • Email

  • SMS

  • Telephone Call, or

  • Facsimile

Spam

Collective Motion Health will only send you commercial electronic messages such as SMS’s or emails in compliance with the Spam Act. Any commercial electronic message that is sent, by Collective Motion Health will identify it as the sender and will include its contact details. If you do not wish to receive such commercial electronic messages, please let Collective Motion Health know or click the unsubscribe link in the message.

Do Not Call Register

Collective Motion Health will not call you on a number listed on the Do Not Call Register unless this is permitted under the Do Not Call Register Act. Please let Collective Motion Health know if you do not wish to receive calls on a particular number.

When Collective Motion Health may disclose Personal and Health Information to Third Parties

In performing Collective Motion Health’s functions and activities, it may be necessary to disclose Personal Information or Health Information to third parties. Third parties may include, where appropriate:

  • Other members of Collective Motion Health team where necessary

  • Other health care professionals, to the extent necessary in the context of providing you with a high quality treatment

  • Financial institutions for payment processing or debt collection

  • Government and other regulatory bodies such as Department of Veterans Affairs, Transport Accident bodies and Workers Compensation bodies, or

  • Your employer, where required and permissible in relation to a work related injury

Data Quality and Security

To the extent required by the Privacy Act, Collective Motion Health will take reasonable steps to:

  • Make sure that the Personal Information and Health Information that it collects, uses and discloses is complete, accurate and up to date

  • Protect the Personal Information and Health Information that it holds from misuse and loss and from unauthorised access, modification or disclosure, and

  • Destroy or permanently de-identify Personal and Health Information that is no longer needed for any purpose that is permitted by the Privacy Act

Cross Border Disclosure of Personal and Health Information

If Collective Motion Health sends your Personal Information and Health Information outside of Australia, it is committed to complying with the obligations under the Privacy Act and will take reasonable steps to ensure that the overseas recipient does not breach the Australian Privacy Principles in relation to the information.

Access and Correction of your Personal Information and Health Information

Please contact Collective Motion Health if you would like to access or correct the Personal Information and Health Information that it holds about you. Collective Motion Health will generally provide you with access to your Personal Information and Health Information and will take reasonable steps to amend any Personal Information and Health Information that is incorrect.

In some circumstances, Collective Motion Health may not provide you with access to your Personal Information and Health Information or may refuse to correct your Personal Information and Health Information, in which case we will provide you with a reason for this decision.
